• I am currently not subject to a domestic violence restraining order of any kind.
• I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence.
• I will not conduct an unauthorized export of any defense articles.
• I have not been adjudicated as a mentally defective and I have not been committed to any mental institution.
• Gunnersoutlet.com is not violating any state or local ordinance or law or by selling or delivering ammunition and/or firearms accessories to me.
• I have not renounced my U.S. citizenship.
• I am not an illegal or unlawful alien, and I am not a nonimmigrant alien.
• The product I am purchasing is meant for personal use, and will not be transferred or sold to another individual or business unless I am an authorized dealer
• I agree to provide any additional information and/or documentation deemed necessary by gunnersoutlet.com to process my order in a timely manner and a failure or refusal to do so will be considered a cancellation and I agree to pay any and all cancellation fees.

Agreement to Indemnify and Defend for Misrepresentation

In the event that any of the above statements under the “Customer Affidavit” section of these Terms and Conditions are determined to be untrue, I will hold harmless, indemnify, release, and pay to defend Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) and its owners, officers, agents, and employees against any resulting civil liability or criminal prosecution.

Shipping

At checkout, your order will be sent via shipping carrier (e.g., UPS). You must designate the address to which your products will be shipped. This information cannot be altered after checkout has been completed. Ownership of products will transfer to you once they are delivered to the address provided at checkout, based on the delivery date and time reflected in the shipping carrier’s records. When products are delivered, you assume all responsibility for them, including the risk of theft or damage. You release Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) and its owners, officers, agents, and employees from all liability and responsibility for all products after delivery. 

Due to commercial restrictions regarding shipping of ammunition, packages cannot be shipped to locations of The UPS Store® or any third party retailer or UPS Access Point™ location. We also typically do not ship to addresses that are defined as “commercial”. Please ensure that your billing address matches the address which your card company or bank has on file, as this discrepancy may delay order processing or lead to possible cancellations of orders.

Release of Liability and Agreement to Indemnify and Defend

I understand and acknowledge that Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) shall not be held liable for any claims and/or damages, or for the breach of any warranty, express or implied, whether of merchantability or fitness for any purpose or otherwise, whatsoever.

I understand and acknowledge that Silver Shield Ammo LLC (DBA Gunnersoutlet.com) expressly disclaims any and all liability for the accuracy of information provided to myself, and/or for how I use information provided to me, by Silver Shield Ammo LLC (DBA Gunnersoutlet.com) . Customer understands that manufacturers are the best resources for information about their products, including critical safety information. I will review all information and safety warnings from product manufacturers prior to purchasing and using products from Gunnersoutlet.com.I understand and acknowledge that Silver Shield Ammo LLC cannot be held liable for how I, or anyone else uses any information I receive from Silver Shield Ammo LLC. Therefore, I explicitly agree to release, hold harmless, indemnify, and pay to defend Silver Shield Ammo, LLC and its owners, agents, officers, and employees against any resulting damages and/or civil liability or criminal prosecution arising from or related to my use of information provided by Silver Shield Ammo, LLC.

By placing an order with Silver Shield Ammo LLC (DBA Gunnersoutlet.com) , I understand and acknowledge that I alone am responsible for how the product which I purchased is used by me, and by any other party that may have access to this product, with or without my consent. I explicitly agree to release, hold harmless, indemnify, and pay to defend Silver Shield Ammo, LLC and its owners, agents, officers, and employees against any resulting damages and/or civil liability or criminal prosecution arising from or related to the products I have purchased, to include but not limited to the use of the product, the storage of the product, and the transportation of the product. In the event that any other party files a claim of any kind against Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) , I will indemnify and pay to defend Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) and its owners, agents, officers, and employees against any resulting civil liability or criminal prosecution.

Jurisdiction

I agree that any complaints filed within any other jurisdiction shall be immediately removed to a court within Strafford Country, New Hampshire and I agree to reimburse Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) and its owners, agents, officers, and employees for any costs they may each incur in defending against the complaint or effecting its removal until such time that the complaint is properly filed within a court located in said county. In the event that I choose to file a complaint against Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) or any of its owners, agents, officers, or employees, I agree that such a complaint must be filed in a court located in Strafford Country, New Hampshire.

Governing Law

I understand and acknowledge that New Hampshire law will govern exclusively: my purchase and use of any products from Gunnersoutlet.com; any information I receive from Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) ; any legal action instituted against me by Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) ; and any legal action that I institute, or that someone else institutes as a result of my actions, against Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) . I acknowledge and agree to abide by all applicable federal, state, and local laws regarding purchase, transfer, use, and disposal of any products purchased from Gunnersoutlet.com.

Class Action Waiver

I expressly agree that any dispute resolution proceedings, including but not limited to, litigation, arbitration, and mediation, will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this express agreement, I acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of any right to bring federal, state, or local claims as any part of, or on behalf of any class or any other individuals, before a court or other tribunal.

Shipping Destination Restrictions

I understand that Gunnersoutlet.com does not ship outside the United States or to Alaska, Hawaii, California, Massachusetts, Chicago, New York City, or any other area within the continental United States where Gunnersoutlet.com is prohibited by federal, state, or local law to ship product. I also understand that if I attempt to have product shipped to these restricted areas, my order will be cancelled and I will be subject to paying a cancellation fee as described below.

(NOTE: We ask our customers to, please, be familiar with their local and state laws in regards to buying ammunition online.)

Order Cancellation by Customers

Order cancellations can be made by customer prior to order being packed. There will be a $25.00 or 10% of total order for restocking, whichever is greater, for any cancelled orders. Customer will be refunded based on payment method’s regulations

Order Cancellation by Gunnersoutlet.com

I understand that Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) reserves the option to cancel any orders where the purchaser has not abided by these Terms and Conditions. In the event that Gunnersoutlet.com chooses to cancel my order, I understand that I will receive a refund of the full amount of the purchase less a $25.00 cancellation fee or 10% of the total purchase amount, whichever is greater.

Returns

I understand that due to the nature of the product that Silver Shield Ammo, LLC (DBA Gunnersoutlet.com) sells, that this company only accepts returns for damaged or defective products, which could have occurred, prior to pickup and shipment. I understand that the product must be returned within 30 days of my order date. Prior to returning any such products, I understand that I must obtain approval from Gunnersoutlet.com’s customer service (Support@gunnersoutlet.com). Also, I understand that I will be refunded via store credit only.

I understand that Gunnersoutlet.com may follow up with me after I place an order and I may contact Gunnersoutlet.com at Support@gunnersoutlet.com for any further information. Additionally, I understand that Gunnersoutlet.com may send me subsequent notices of product specials and announcements and that by submitting my order, I understand that I may unsubscribe from future contacts, regarding specials or newsletter, per Gunnersoutlet.com’s Privacy Policy. This, however, does not relieve me of any responsibility to answer any follow-up communication, regarding any required documentation requested from Gunnersoutlet.com.

Intellectual Property

I expressly acknowledge that all content on the website Gunnersoutlet.com is intellectual property of Silver Shield Ammo LLC, or was provided to them by third party at that third party’s consent, and cannot be used by anyone without the consent from Silver Shield Ammo LLC management. I am aware that Silver Shield Ammo LLC (DBA Gunnersoutlet.com) may pursue legal action, if any of its intellectual property is used without this company’s proper, prior consent.
